Terms of Service

This is a working draft. It describes how the service actually operates today and will be replaced by a reviewed version before the first paid account.

These terms cover the use of hempscale.eu and the HempScale service. By starting an analysis or opening an account you accept them.

What the service does

HempScale reads the publicly available pages of a customer shop, builds a brand profile from them, produces a content plan and produces Instagram content in the customer brand. Every text is checked against a rule engine covering platform policy and advertising rules before it is rendered, and rendered images are checked again afterwards.

Publishing to Instagram runs exclusively through the official Instagram Graph API and requires the customer account to be connected and approved. Until that is in place, finished content is delivered as files and captions.

What the service does not do

HempScale does not give medical, legal or regulatory advice. The compliance engine reduces risk, it does not remove it, and it does not replace review by the customer or by the customer legal counsel.

HempScale does not guarantee reach, engagement, sales or any other outcome, and does not guarantee that a platform will not restrict an account for reasons outside the produced content.

The customer account and content

The customer keeps ownership of everything produced for them and of everything they supply. HempScale keeps the right to operate the service on that material, including storing it, rendering it and publishing it where publishing has been authorised.

Content produced for a customer stays available for 12 months after the subscription ends.

Payment

Subscriptions are billed monthly or annually through Paddle, which acts as merchant of record and handles VAT. A first paid month can be refunded within 14 days. A failed payment pauses production after 7 days rather than deleting anything.

Ending the agreement

Either side can end the agreement at any time with no minimum term. HempScale may suspend an account that breaches the acceptable use policy, and will say why.

Liability

To the extent permitted by law, liability is limited to the fees paid in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
